Neighbour dispute, any advice please

My neighbour lives in rented accommodation, and the landlord and council have agreed plans to modernise the front of the property, giving level access for a disabled person.The upper neighbour has objected to any modernisation to the property on the stupidest of grounds i.e. they want their garden approx 12 feet by 2 feet, full of weeds.From what I can gather, the upper neighbours have aggravated the lower flat with noise nuisance over many years and have laid wooden floors. Also the upper neighbours claim to have bought the garden patch from a previous tenant. That in its self must be illegal. The upper people cannot supply proof that the front patch of garden is on their tenancy agreement.The council cannot proceed with the adaptation until the upper neighbours stop their silly protests. Should my neighbour take legal action against the other, as it seems that harassment and unreasonable behaviour come into play.Any advice please.

Hello Sylvia,I'm not a lawyer, but I would refer your neighbour to the owner of the freehold for the property (their landlord, I would assume), who can prove they own the patch. Clearly, tenants (the upper ones) can not simply purchase a piece of land. Whilst your neighbour is chasing the freeholder, I'd be asking the upstairs neighbours to provide the title for their purchase. They certainly won't have it.
