Planning: 24 hour opening for Mcdonald's on Acton High St
They are trying to get this through on the basis that there was no restriction on opening hours when original change of use was granted. Technically they are not saying that they will open 24 hours - but are seeking confirmation that they would be allowed to."Planning permission (ref. 16744/3) was originally granted for change of use from retail (use class A1) to restaurant (Use Class A3) on 4 March 1981. There are no restrictive conditions relating to opening hours on the decision notice"However, there is a clause that says that they must"ensure that the proposed development does not give rise to conditions prejudicial to the enjoyment by neighbouring occupiers of their properties". But this is limited to the ventilation or extraction equipment. If this is confirmed then I think that it could have significant implications throughout the borough because it could mean that if the council does not specifically include hours of opening limits within its grants then everyone who wants 24x7 could simply go for it.https://pam.ealing.gov.uk/online-applications/centralDistribution.do?caseType=Application&keyVal=OEBAHGJMHFO00
