The demolition of the house at No.91 on Monday would be totally unlawful - no 21 days Notice has been put up on the land - no 28-day application for "prior approval" of demolition has been granted by Ealing Council (let alone submitted!). Following the submission of a "prior approval" application to the Council, the Council has 28 days in which to request details of the demolition and details of the proposed restoration. After that request, the developers must submit the details. The Council then has 8 weeks in which to consider those details and give its decision. The Council may wish to preserve the building or declare a Conservation Area, etc. Thus, for at least 12 weeks, no demolition may proceed. The existing law (as referred to in Circular 10/95, which has just been strengthened) makes Monday's proposed demolition unlawful and it is separate to any additional EIA requirements arising out of the new case referred to by the Government's Chief Planner in his letter dated 31/3/11 (previously sent).
