Council states that Hanson Cement application must be Delegated, not decided by Planning Committee:-

SHLAP has insisted that the Hanson Cement (Horn Lane Industrial Estate) application for a Lawful Development Certificate be decided by a full Planning Committee, however Planning Services state:-"I would like to advise you that, being an application for a lawful development certificate, this is not the type of application that would be presented to Committee for determination. This is because determination relies on a legal interpretation of the submission and not a policy interpretation."Any legal bods out there know if this is incorrect/challengable?This is FAR too important to be delegated and decided behind closed doors, whatever the reasons.

I thought one of the councillors - can't recall which but it wont have been Pa\tricia Walker - said that this wasn't going to be delegated.

Well, the letter is clear enough - it IS going to be Delegated.And therefore arbitrarily decided behind closed doors.

I thought delegated powers were supposed to be for non-contentious applications.Isn't there a list somewhere of what sort of applications can't be decided under delegated powers (the Planning Officer rather than the Planning Committee) eg the Council on its own applications, ones needing Environmental Impact Assessments, ones that the public consider need more discussion etc?
